This Licensing Agreement is between you (the “Licensee”) and me, Øraeth (the “Licensor”), for music licensed on this website (the “Works”). It covers paid licenses only. By buying a license, you agree to these terms.
My guarantee
All recordings and compositions on this site are protected by copyright and registered for royalty collection. Any use outside a purchased license or the free-use terms is copyright infringement.
I own or control all rights in the recordings and compositions needed to grant the licenses offered on this website.
Your guarantee
You agree to use the Work within the scope of the license you buy. Not sure which tier fits your project? Contact me before buying.
1 · Grant of license
I grant you a non-exclusive, perpetual, worldwide license to use the licensed track within your tier, as stated on your license certificate. This includes the right to synchronize the music with your content, include it in your production, and reproduce, distribute and publish that finished production through the media your tier allows.
I keep full ownership of the music, the sound recording and the composition. A license does not transfer ownership.
2 · What each license covers
- Creator — $19. For personal, non-commercial projects: your own YouTube channel and social media, monetized videos included, vlogs, travel and family videos, weddings and birthdays, school work, study and presentations. Use it in as many of your own projects as you like. Platform monetization alone does not make a personal project commercial. Not covered: content made for a business, brand or client, advertising, commercial products, apps, games or software, podcasts, and public playback. For those, choose Business.
- Business — $49. Everything in Creator, plus commercial projects: content made for clients or brands, digital paid advertising, podcasts, music on hold, public playback in shops, bars, restaurants and hotels, and apps, video games and software by independent or small-to-mid-size studios with a total production budget up to $50,000 USD. Use it in as many projects as you like. Larger games, apps and ad campaigns need a Broadcast license.
- Broadcast — from $229. For one production: a film, documentary, series, TV or radio program, OTT release, TV or cinema commercial, AAA game or large-scale campaign. On some tracks the price depends on the production type, budget, distribution and use of the music. The final price and scope are shown before payment and recorded on the certificate.
One production (Broadcast). The production named on your certificate, including all its versions: trailers, teasers, promos and cut-downs of a film; every episode of every season of a series; every ad and edit of a campaign. Using the track in a different production needs another license. Working on several productions? Contact me for a multi-production deal.
Each license covers one track and comes with a certificate in the Licensee's name. The WAV and MP3 are included if you choose them at checkout. Venues: the license covers the use of the recording; in some countries a venue also needs its own general music license from a local collecting society.
Collections. A collection license covers every track listed in the collection and on its certificate, under the chosen tier (Creator or Business), with the same rights and restrictions as licensing each track on its own. Broadcast is licensed per track.
3 · Stems
Broadcast licenses include stems, sent by email. With a Business license, stems are available on request. Stems are part of the licensed Work and follow the same rules as the track.
4 · Editing the track
You may edit the track to fit your project: cut, trim, loop, fade, shorten, extend, change the volume or tempo, remove or reduce vocal elements where technically possible, and mix it with dialogue, voice-over and sound effects.
You may not turn it into a new piece of music: no remixes, covers, re-recordings, or new songs made by singing or rapping over it. You may not release the track, or any edited version, as your own music, or sell, license or share it as standalone audio.
5 · Work for clients
With a Business or Broadcast license, you may use the track in content you make for a client. Your client may publish and use that finished content without buying another license. The license stays with the Licensee named on the certificate; the client may not reuse the music in other projects.
6 · Restrictions
You may not:
- Resell, share or redistribute the audio files on their own, including in sample packs, music libraries or stock sites.
- Sublicense the music, or claim authorship or ownership of it.
- Register the music, or any content containing it, with YouTube Content ID or any other rights-management or fingerprinting system. This is never allowed, for any use.
- Use the music to train AI models, or in NFTs.
- Use it in content that is unlawful, hateful, defamatory or offensive.
Buying a WAV or a license never allows you to release, distribute or register the music as your own. Doing so is a serious breach that ends your license immediately (see section 12), and I'll request the removal of that release from the platforms where it appears.
7 · YouTube Content ID, whitelisting & proof
My music is registered with Content ID to protect it from re-uploads and copies. It is never used against videos licensed on this site. Licenses don't expire, and tracks are never withdrawn to claim videos that used them legally.
At checkout I ask for your channel or video link so I can whitelist it, normally within 24 hours. If a claim appears on a licensed video, send me the video link or your Order ID and I'll have it released within 48 hours of receiving it. If a claim comes from a third party, I'll take care of it through my distributor and rights partners.
Your certificate and Order ID are your proof of license. Anyone can check them on the recover page.
8 · Cue sheets & performance royalties (Business & Broadcast)
My compositions are registered with BMI, and my recordings with PPL. Your license covers using the music in your project. It doesn't replace the public-performance and broadcast licenses that broadcasters, streaming platforms and venues hold with collecting societies. They pay those royalties through their own blanket licenses, so you pay nothing extra.
When a Business or Broadcast project is used on TV, radio, in cinema or on streaming platforms, list the track on the production's cue sheet using the composer and publisher details on your certificate. Social media and online-only use don't need a cue sheet.
9 · Exclusivity & transfer
All licenses for tracks in my catalog are non-exclusive: I may keep licensing them to others. Existing tracks are not sold exclusively. If you need music made only for you, contact me about a custom track; exclusivity is then set out in a separate written agreement. Licenses can't be transferred without my written consent.
10 · Attribution
With a paid license, credit is not required, though it's always appreciated.
11 · Payment & refunds
Prices are in US dollars, paid through PayPal, at the price shown when you buy (after any valid coupon). At checkout you agree to immediate delivery of your license and files and acknowledge that, once delivery begins, you lose any right of withdrawal, to the extent the law allows. Apart from rights the law gives you, all sales are final. If something on my side fails (a download, the certificate or whitelisting), contact me and I'll put it right.
If a payment is reversed or charged back, the license is suspended while the dispute is open. If the payment is not completed, the license is cancelled and the content using the track is no longer covered.
12 · Suspension & termination
If you break this agreement and it can be fixed, I'll tell you and give you a reasonable time to fix it. The serious breaches listed in section 6, and any deliberate infringement, end the license immediately. When a license ends, you must stop using the music, including in content already published.
13 · Rights claims & liability
If anyone makes a valid claim that your licensed use infringes their rights, I'll resolve it in the way that fits the case: clearing the rights, replacing the track or refunding your license. Tell me about any claim promptly and help me deal with it. I'm not responsible for claims caused by uses outside your license, by changes beyond those allowed in section 4, or by other material in your project. Apart from that, my total liability is limited to the price you paid for the license, except where the law doesn't allow a limit. This limit doesn't affect my commitment to release claims under section 7.
14 · Legal compliance
You're responsible for making sure your project complies with the law and with the rules of the platforms you publish on.
15 · Changes to these terms
I may update these terms for future purchases. Your license always follows the version in place on the day you bought it: that version is linked on your certificate and in your confirmation email, and it stays online. Content you've already published stays covered when these terms change.
16 · Disputes & governing law
Any dispute will first be addressed in good faith between you and me. If it can't be resolved, this agreement is governed by the laws of the Republic of Angola, and the courts of Luanda have jurisdiction. This does not remove any consumer protection that the law of your country gives you.
17 · Acceptance
This agreement is available on this page. Buying a license confirms that you've read and accept it. Your purchase record, certificate, tier and any production details form part of the agreement.
Store purchases (WAV for listening)
Tracks and releases bought in the Store are for personal listening only. A Store purchase is not a license: it gives no right to use the music in videos, podcasts, ads, streams or any other content. Free-to-use tracks can still be used with credit under the free-use terms; any other use needs a license. Store files may not be resold, shared or uploaded elsewhere. At checkout you agree to immediate delivery and acknowledge that you lose any right of withdrawal once delivery begins. Apart from rights the law gives you, Store sales are final.
